The Abu Dhabi Civil Family Court has ordered a man to repay more than Dh182,000 to a private company after finding him liable for embezzlement. The judgment follows a separate criminal case where the man had already been convicted for the same conduct.
Civil Claim
The private institution filed a civil claim to recover Dh182,062 that the defendant had unlawfully taken for personal use. The company also sought an additional Dh50,000 in compensation for the material and moral damages it sustained.
Court records showed that the man had previously been prosecuted in a criminal court over the misappropriation of funds. In that case, he was fined Dh50,000, a ruling that was later upheld by an appeal court.
In the subsequent civil proceedings, the defendant did not appear in court or provide any evidence to challenge his liability for the embezzled amount. The court based its decision on the existing criminal conviction, which had already established his guilt.
The court ordered the man to repay the full Dh182,062 to the institution. Regarding the separate claim for compensation, the court acknowledged that the company, as a profit-based entity, had suffered material losses that affected its financial standing. It awarded the firm Dh5,000 for the tangible damage caused by the defendant’s actions. The man was also ordered to cover all court fees and expenses.
